PRIVACY AGREEMENT

American Security Programs understands that users may have concerns about privacy. This Policy describes how American Security Programs will process and use personal information. We will make every effort to ensure that our activities keep with the spirit of this Policy. Please note that by accessing, using, or consuming our web site and its content, you are acknowledging and accepting the practices described in this Privacy Policy.


NATURE OF COLLECTED INFORMATION

Through the regular and routine course of interaction with our web site and severs, American Security Programs may collect a variety of information, including but not limited to 1) the type of internet browser you are using; 2) the type of operating system on your computer; 3) the name of your internet service provider; 4) your IP address; 5) the present location of the computer that you are using to access the web site; 6) your domain name; 7) your "click path"; 8) the address, domain, and physical server location of the page that linked you to our site; 9) the address of the page from which you exited our site; 10) the time and date that you accessed each page; 11) the name and physical address of your employer; 12) Personally Identifiable Information (PII), including but not limited to your name, physical address, email address, zip code, phone numbers, and fax number; 13) other data or information volunteered by the user or otherwise submitted or transmitted to American Security Programs through emails, messages, registrations, live chats, files, attachments, or forms; or 14) other information collected about you from third parties during or as the result of your web browsing.


METHODS OF INFORAMTION GATHERING

Our web site, our server, or our code may collect information 1) automatically, without the user becoming aware of the transmission, and without any alert, warning, or prompting; or 2) through active and voluntary submissions received from the user.

We reserve the right to use any and all available technologies to gather data, including but not limited to these technologies and mechanisms:
  1. Cookies: Cookies are bits of data sent to and stored by your browser. A cookie cannot read data from your hard disk or read cookie files that may have been created from other sites. Cookie data may include, but not be limited to: 1) session tokens and other relatively anonymous user identification data; 2) pieces, elements, or fragments of personally identifiable information; 3) user preference data; 4) security permission data; 5) previously submitted data from multi-page form fields; or 6) page visitation and click history. Users are not usually prompted or alerted when data is gathered from cookies.

  2. “Get” and “Post” Requests or Strings: When a user attempts to access any web page over the internet through http or https protocols (i.e., standard web browsing), the user’s computer sends a bundle of specially formatted data, called a “page request,” to the server that hosts the desired web page. Page requests are generated whenever a user enters any web address in their web browser window. Page requests are also generated when a user clicks on any type of link. The Page Request can include a variety of special data and information. The transmitted information may include, but not be limited to 1) the IP address of the user; 2) the type of web browser being used; 3) the operating system of the user’s computer; 4) tokens and character strings that instruct the server how to correctly respond; 5) tokens and character strings that share, disclose, or otherwise enable the server to identify the user; 6) tokens and character strings that carry raw and un-encoded personally identifiable information; 7) tokens and character strings that would reveal or suggest the existence of relevant cookies; 8) tokens and character strings that would enable the server to deduce the identity, source, location, or address of the link that resulted in the page request. Users are not usually prompted, or alerted, or otherwise notified of the content of page requests.

  3. Forms: A number of our web pages include special fields through which users may actively submit information to American Security Programs. The pages that use such fields presently include, but are not limited to, our employment application, our login page, and our “contact us” page. The fields that are included on these and other pages may be used to submit a variety of information, including but not limited to Personally Identifiable Information (PII), such as your name, address, phone number, email address, zip code, and other information. Typically, users must volunteer and actively declare the data and information that American Security Programs would collect and process through form fields.

  4. Web Services: A variety of tools and services are available that enable companies to gather additional data about website visitors. American Security Programs may use any or all such tools and services to gather additional information about users. The gathered information may include but not be limited to Perosnally Identifiable Information (PII). Use of such services typically requires the submission of known user information to third party servers for processing and analysis. A common example of such services is “IP Lookup,” which would potentially enable American Security Programs to accurately deduce the identify of a user – including but not limited to the user’s name, address, zip code, phone number, or employer – based strictly on the analysis and processing of the user’s IP address.

USE AND DISCLOSURE OF INFORMATION

American Security Programs considers the collected information to be the non-confidential property of American Security Programs. We do reserve all rights with regard to the information and data that we collect. This includes the right to combine or integrate any or all collected data for the purpose of gaining additional insight, clarity, or detail about users. We do not place any limitations on the use or exploitation of the information or the data that we collect. We moreover specifically reserve the right to disclose, assign, share, or sell collected information or data, without restriction, with third-party service providers and business partners.

Notwithstanding the above reservation of all rights (in the preceding paragraph), which has primarily been incorporated here for the reason of avoiding certain liabilities, we do acknowledge that users might prefer that we do not disclose, share, or sell certain information. We do represent that it is not presently our intention to sell any gathered information to third party vendors. However, our intention may change at our sole discretion, without notice, such that we may in the future choose to engage in any such disclosures, assignments, sales, or sharing.

Use of any or all data or information is at our sole discretion. At present, we are most inclined to use the collected information as follows:
  1. To improve our understanding of our web audience and our prospective market;
  2. To tailor, optimize, or improve our communications, including, but not limited to, the content, features, code, or design of our web site;
  3. To record, track, and analyze web page access and use;
  4. Improve our business processes and system automations;
  5. To cultivate or identify business opportunities;
  6. To offer products and services;
  7. To convey promotional information;
  8. To improve relations with customers, clients, or prospects;
  9. To facilitate communications with employees or prospective employees;
  10. To protect and defend the rights of American Security Programs;
  11. To protect against misuse or unauthorized use of our web site and infrastructure;
  12. To gather additional information or business intelligence through third party services; or
  13. To support other legal endeavors that would potentially result in the prevention, prosecution, or punishment of criminal behavior.
OPT-OUT CHOICES

Most internet browsers will allow you to erase cookies from your computer’s hard drive, block acceptance of cookies, or receive a warning that a cookie is stored. Please note, however, that if you block cookies, some portions of American Security Program’s web site may not function properly. Your computer user’s manual, or your software’s help screen, may contain more information pertaining to the control of cookies

All submission of form data is of the user’s own initiative, and is furthermore at the user’s own risk and sole discretion. By submitting form data, the user user is expressly acknowledging and agreeing with the terms of this Privacy Agreement, as well as the terms of information submission that can be found at www.securityprograms.com/legal/termsofuse.aspx.


DATA SECURITY

American Security Programs takes reasonable precautions to keep sensitive information from being disclosed unintentionally. We have implemented security policies, rules and technical measures to protect your personal data from unauthorized access, improper use or disclosure or unauthorized modification. We also advise all employees about their responsibility to restrict the release of information in accordance with our company's business policies and ethical standards. However, although we do have such policies and procedures, we do not represent or make any warranty that our web site or our web services are fully secure or impervious to attacks or malware.


USER ACCOUNTS AND PASSWORDS

Should you choose to register with American Security Programs, you will gain privileged access to certain pages under the Resources area of our web site. You are responsible for maintaining the confidentiality of the account ID and password that you would use to access this Resource area. You are responsible for all activities that occur under your password or account.

By accessing, or otherwise by registering for access to , the Resources area of our web site, you agree to 1) immediately notify American Security Programs of any unauthorized use of your password or account, or any other breach of security, and 2) ensure that you exit from your account at the end of each session.

American Security Programs expressly prohibits and forbids the use of any “Common Personal Passwords” (CPP) on our system. We define CPP as any string of keyboard characters that would end up sharing more than 75% (rounded up) of its sequenced characters with another electronic password used elsewhere by same password owner. The actual quantity of shared characters in any two passwords would be calculated by counting the total number of characters in either password, and then multiplying the count by .75 (rounded up). For instance, if a user held an account on another system, and access to the other system would require the user to enter the password “Frogs” (i.e. a total of five characters), then the same user would be prohibited and forbidden from using on American Security Program’s systems any password including a sub-selection of four characters in the same sequence (ex. “frog”, “rogs”).

By accessing, or otherwise by registering for access to, the Resources area of our website, you agree that American Security Programs may access, preserve, or disclose your account information, including but not limited to your password. The option of disclosure extends to, but is not limited to, any situation where we may be required to do so by law or in a good faith belief that such disclosure is reasonably necessary to: 1) comply with legal process; 2) enforce the ASPWA; 3) respond to your requests for customer service; or 4) protect the rights, property or personal safety of American Security Programs, its users, or the public.


DISCLAIMER AND LIMITATION OF DAMAGE AND LIABILITY

All attempts to access or use American Security Programs’ web site are subject to the terms of the American Security Programs Web Service Agreement (ASPWA). The agreement can be found at www.securityprograms.com/legal/termsofuse.aspx.

Use of American Security Programs’ web site and web services is at each user’s own risk. American Security Programs cannot and will not be liable for any loss or damage arising directly or indirectly from a user’s interaction with, or a user’s transmission of information to, our web site. We especially cannot and will not be liable for any loss or damage arising directly or indirectly from a user’s failure to comply with the terms of the section entitled “User Accounts and Passwords.”
